Welcome to Sale Gates
By using the Sale Gates application, you acknowledge and agree to these Terms of Use.
By accessing and continuing to use the platform, you confirm that you accept these Terms of Use and acknowledge and agree that they govern and restrict your access to and use of the platform and any content available on it.
You understand that these Terms of Use constitute a legally binding agreement between you and Sale Gates.
If you are using the platform on behalf of a business entity, you represent and warrant that you have the legal authority to bind that entity to these Terms of Use.
If you do not agree to comply with these Terms of Use, you may not access or use the platform or any of its content and must immediately cease doing so.
Advertisement Publishing Rules and Guidelines
Restrictions
You may not:
- Use the platform if you are under 18 years of age.
- Use the platform unlawfully or for any illegal purpose.
- Attempt unauthorized access to the platform, its servers, or connected databases.
- Interfere with or damage any part of the platform, its content, or systems.
- Introduce viruses, malware, or harmful software.
- Impersonate any person or entity.
- Behave in a rude, abusive, or harassing manner.
- Use the platform to create unsolicited advertisements or spam messages.
- Reproduce, copy, sell, resell, or commercially exploit any part of the platform.
- Use tools or software for data extraction, scraping, crawling, or automated copying.
- Attempt to reverse engineer, decompile, or analyze the platform’s source code.
Any violation of the above restrictions will be reported to the relevant authorities.
Advertisements may only be posted after registering with a mobile phone number and email address.
The advertiser must categorize and publish the advertisement under the correct section.
The advertiser must provide an accurate title, product description, price, and images. The advertised item must be genuine and available.
The advertiser must be the owner of the advertised item or service.
Advertisements are intended for personal use only. Commercial advertisements, advertisements on behalf of others, and advertisements related to companies or stores are prohibited.
Advertisements containing offensive language, inappropriate images, illegal content, or content intended to defame individuals or organizations are prohibited.
Advertisements for the sale of weapons of any kind, whether licensed or unlicensed, are prohibited.
Each advertisement must relate to a single item only. Multiple items require separate advertisements.
Advertisements by lawyers intended to promote legal services or attract clients are prohibited.
Advertisements that violate the laws of the advertiser’s country or the laws of the State of Kuwait are prohibited, including but not limited to:
- Law No. 63 of 2015 on Combating Cybercrimes.
- Law No. 38 of 2002 regulating the advertisement of health-related materials.
Advertisements for medicines and sexual enhancement products are prohibited.
Advertisements related to smoking products of any kind, including electronic smoking devices, are prohibited.
The sale of endangered plants and animals listed under the CITES Convention is prohibited in compliance with the regulations of the Environment Public Authority.
Advertisements related to domestic workers of all types are prohibited, including advertisements for fictitious domestic labor, hourly labor rental, or any form of human trafficking.
Advertisements related to gambling, betting, magic, or sorcery are prohibited.
Advertisements for alcohol, alcoholic beverages, drugs, cannabis, or any narcotic substances are prohibited.
The display or sale of wiretapping devices and means that encourage misuse of telephone communication devices is prohibited under Law No. 9 of 2001 concerning the misuse of telecommunications devices and surveillance equipment.
Advertisements related to loan settlements, cash conversion services (Takyeesh), furnished apartments rented by the hour, or daily rentals by unauthorized entities are prohibited. Advertisements promoting investment opportunities, investment solicitation, or business partnerships are also prohibited.
Sale Gates reserves the right to block any phone number used to abuse the platform, harm others, or engage in unlawful activities.
Users must respect other visitors and users of the platform.
Reserving advertisements or featured placements for resale to another party is prohibited.
The user publishing the advertisement bears full legal responsibility and liability for any legal claims or compensation without any responsibility on Sale Gates.
The customer acknowledges that they have reviewed and accepted all general and specific terms governing the use of the platform's services. The customer assumes full legal responsibility, both civil and criminal, for any damages caused to the application, website, operators, or third parties resulting from violations of laws, regulations, or advertising requirements. Accessing or using the application or website constitutes acceptance and acknowledgment of these obligations.
Advertisers offering skilled trades or professional services must hold the necessary licenses from the relevant authorities.
Users are advised to verify the existence of required licenses and documentation before contracting with service providers. Sale Gates bears no responsibility in this regard.
If it is determined that an advertiser offering skilled services does not possess the required license, the advertisement will be removed and the advertiser’s information may be provided to official authorities upon request.
Sale Gates reserves the right to prevent any user from using the platform if they fail to comply with these Terms.
Advertisers are not permitted to publish the same advertisement multiple times. Duplicate advertisements, whether posted intentionally or unintentionally, will be removed without prior notice to maintain an organized marketplace and fair user experience.
If any product violates the regulations of the Ministry of Commerce and Industry or electronic commerce laws, the seller bears full legal responsibility before the competent authorities, and Sale Gates shall bear no liability.
Changes to the Platform
We may make changes to the platform.
We may change how the platform operates and/or modify any content from time to time without notice. Such changes may be necessary to keep up with technological developments, market practices, applicable laws and regulations, or business priorities.
Advertisement Duration
The duration of an advertisement is one month from the date of publication.
Advertisements are automatically removed after the specified period determined by Sale Gates.
Advertisements that violate these Terms may be removed without notifying the user and without compensation.
Once an advertisement is removed, it will no longer be visible in the "My Listings" section.
Sale Gates reserves the right to suspend or permanently ban any user who publishes prohibited advertisements or sends abusive messages to others through private messaging.
Privacy and Sharing of User Information
Sale Gates is committed to maintaining the confidentiality of user information.
User information is only shared within the limits authorized by the seller when publishing an advertisement, such as information entered in communication fields including phone numbers and email addresses.
Users must not publish advertisements that violate the laws of the State of Kuwait.
By publishing advertisements that violate Kuwaiti law or by sending inappropriate comments through internal messaging, users agree that their information may be disclosed to competent governmental authorities if requested.
As part of the ongoing cooperation between the Cybercrime Department in Kuwait and Sale Gates, any advertisement violating Kuwaiti law may be reported to the relevant authorities.
Users must respect intellectual property rights and trademarks belonging to others and must not misuse internal messages, comments, or advertisements to harm others.
If Sale Gates determines that such violations have occurred, it may provide the offending user’s information to affected parties upon request.
Changes to These Terms of Use
We may amend these Terms of Use from time to time, with or without prior notice.
Updated versions will be made available on this page.
If you are a registered user, we may also notify you of significant changes via email where legally required.
Whenever you use the platform, you should review these Terms of Use to ensure that you understand the terms and conditions applicable at that time.
Intellectual Property Rights
Sale Gates owns all intellectual property rights related to the application and all content available through it, including data, images, and intellectual content in all forms.
Under no circumstances may any person copy, reproduce, extract, or systematically collect the content of the application in whole or in substantial part.
The content of this application may not be incorporated into any other intellectual work or electronic database.
The resale, redistribution, modification, translation, or reverse engineering of any content from this application is strictly prohibited.
Sale Gates reserves the right to impose restrictions necessary to prevent any person or website from linking to, copying, or reproducing content from the application.
Reverse engineering, decompiling, or disassembling the software used in the application in an attempt to access its source code or original architecture is strictly prohibited.
Assignment of Advertisements and Uploaded Images
By uploading an advertisement and its associated images to the platform, the user is deemed to have granted Sale Gates the right to use such content.
Sale Gates reserves the right to reuse images published in advertisements in any manner it considers appropriate.
Violation of Terms
We may suspend your account, revoke your right to use the platform, or take legal action in response to violations of these Terms.
